Eduard Babaryka

Eduard Babaryka headed the 2020 election campaign team of his father, Viktar Babaryka. He was arrested on June 18, 2020, together with his father, on their way to the Central Election Commission, by the Department for Financial Investigations of the State Control Committee. Their lawyers were not allowed to visit the detainees during the entire day. On the same day, Eduard Babaryka was placed in the KGB remand prison.

Eduard Babaryka graduated from the Belarusian State Economic University with a major in Economics and Business Management. He managed the Ulej and MolaMola crowdfunding platforms. He is fond of horse riding and diving. His friends describe him as a leader inspiring others and striving to create a product or service that would benefit society. 

On June 21, 2021, Eduard Babaryka was charged under Article 243 ('Tax evasion on a particularly large scale').

In the remand prison, he practiced yoga, read, learned to draw, and asked to send him books on chess.

In late November 2021, information appeared that he had been transferred from the KGB remand prison to remand prison #1, both in Minsk.

According to preliminary information, as of December 2021, Eduard Babaryka was also a suspect under Part 3 of Article 130 ('Incitement to hatred') and Part 1 of Article 293 ('Organization of mass riots'). His status in the criminal case related to the alleged tax evasion remained unknown.

In the middle of February 2022, Eduard Babaryka's detention was again prolonged: he was to remain in custody until April 14, 2022. On May 22, 2022, Judge Mikhail Makarevich dismissed Eduard Babaryka's and his lawyer's complaints against the prolonged detention. On May 25, 2022, during a closed hearing at the second instance, Mikhail Lapko also dismissed the complaints.

On August 25, 2022, Eduard Babaryka's complaint against another detention prologation was dismissed by the Partyzasnki District Court of Minsk.

The political prisoner served a record pretrial detention term. Another complaint against his prolonged detention was dismissed on December 14, 2022.

On May 22, 2023, the trial of Eduard Babaryka began in the Minsk Regional Court, on the premises of the Minsk District Court. It became known that the political prisoner was also accused under Part 2 of Article 235 of the Criminal Code ('Legalization (laundering) of funds obtained through criminal means').

According to the indictment, Eduard Babaryka, who was arrested on June 18, 2020, assisted Siarhei Tsikhanouski, who was arrested on May 29, 2020, in organizing mass riots. Besides, Eduard Babaryka was also charged with income tax evasion from 2012 to 2022 (Eduard Babaryka was in custody from June 18, 2020).

Eduard Babaryka pleaded not guilty.

On July 5, 2023, the Minsk Regional Court announced the sentence to the political prisoner, who had been detained for more than three years: Judge Uladzimir Areshka sentenced Eduard Babaryka to eight years of imprisonment in a maximum-security penal colony—two years less than requested by the prosecutor Aliaksandr Karol. The State Prosecutor's Office dismissed the charges of crime proceeds legalization and reclassified the charges of "organization of mass riots" to "organization of actions that grossly violate public order" (Part 1 of Article 342 of the Criminal Code).

The 18 months of detention in the KGB remand prison under tax evasion charges (until December 14, 2021) were not considered in the sentence—he was convicted in the second criminal case that was initiated right after the maximum detention term ended.

According to the schedule, the Supreme Court began consideration of Eduard's appeal on November 27. The decision will be made by a judicial panel chaired by judge Ihar Bukat. According to the Supreme Court's telegram channel, the verdict remained unchanged.

      On December 1, 2023, Eduard was added to the "extremist list" by the Ministry of Internal Affairs.

      On December 5, 2023, the KGB added Eduard to the "terrorist list".

Eduard Babaryka receives 8 years in jail

On July 5, 2023, the Minsk District Court delivered a verdict against political prisoner Eduard Babaryka, who has been held in custody for over three years. He was sentenced to eight years of a medium-security penal colony. Babaryka was charged with incitement of hatred (under part 3 of Article 130), organizing mass riots (part 1 of Article 293), and tax evasion (part 2 of Article 243 of the Criminal Code). The state prosecution dropped the charge of money laundering under part 2 of Article 235 of the Criminal Code. Judge Uladzimir Areshka assigned him two years less than Prosecutor Aliaksandr Karol requested. The case was examined in an open court session on the premises of the Minsk District Court from May 22.
